Clear Terms, Clearly Stated.
These terms apply to every deposit, payment, and booking made with EXG Safaris LLC.
1. General Terms
By submitting payment of any deposit or balance for an EXG Safaris trip, you (“Traveler,” “Client,” or “Participant”) acknowledge and agree to these Terms and Conditions.
EXG Safaris LLC (“Company,” “we,” “our,” or “EXG Safaris”) is a California limited liability company and operates in partnership with licensed ground operators in Africa.
These terms supersede all prior verbal or written communications.
2. Deposits and Confirmations
2.1 Deposit
A non-transferable deposit equal to 20% of the total trip cost is due to confirm your booking.
No booking is deemed confirmed until the required deposit has been received and acknowledged by EXG Safaris.
2.2 Final Payment
Balance of payment is due 90 days in advance of your arrival date, unless otherwise specified by EXG Safaris.
Failure to remit payment by the due date may result in automatic cancellation and forfeiture of all deposits and fees paid.
2.3 Payment Methods
Payments may be made by credit card, ACH, or wire transfer.
All credit card transactions are subject to a 3% processing fee.
3. Cancellations by Traveler
To cancel your trip, please send an email to info@exgsafaris.com.
Applicable refunds will be issued to the card used for payment according to the following schedule:
91 days or more prior to departure: Deposit will be refunded, minus a $350 per person administrative fee.
90–61 days prior to departure: 50% of the total trip cost will be refunded.
60–46 days prior to departure: 35% of the total trip cost will be refunded.
45 days or less prior to departure: No refunds will be issued.
The $350 per person minimum administrative fee is non-refundable once paid, regardless of the cancellation date or reason.
4. Cancellations or Modifications by EXG Safaris
EXG Safaris reserves the right to modify itineraries, dates, accommodations, or vehicles for safety, logistical, or regulatory reasons.
If EXG Safaris cancels a safari due to force majeure (e.g., natural disasters, political unrest, epidemics), all payments will be credited toward a rescheduled safari within 24 months or a trip to another destination.
EXG Safaris is not responsible for additional expenses (e.g., airfare, visas, vaccinations) incurred by travelers.
5. Client-Requested Changes & Rescheduling
5.1 Modification Requests
Any request to modify a confirmed booking must be submitted in writing and is subject to availability and approval by EXG Safaris. EXG Safaris may apply additional charges for modifications, or treat a substantial change as a cancellation and rebooking.
5.2 Flexible Rescheduling
In the event of unforeseen circumstances (geopolitical instability, armed conflict, airspace closures, governmental travel restrictions, or significant transportation disruptions), EXG Safaris may, at its sole discretion, permit rescheduling under these conditions: the rescheduled travel must occur within the same calendar month in the subsequent travel season; no rescheduling fee is charged, though any increase in third-party supplier costs is borne by the traveler; and written notice with updated travel details must be received no later than 90 days before the newly proposed departure date.
5.3 Limitations
Rescheduling is offered as a goodwill accommodation, not a contractual right. It is strictly subject to availability and operational feasibility, and does not apply to bookings already canceled or completed.
5.4 Effect of Rescheduling
Once a traveler accepts a rescheduled date, the original booking is fully amended and replaced. The rescheduled booking is final and non-refundable, and does not create any additional cancellation or refund rights.
6. Refunds and Chargebacks
Refunds, if applicable, will be processed within 30 business days of written approval.
Chargebacks are strictly prohibited without prior written communication and resolution attempt.
Any unauthorized chargeback will incur a $250 administrative fee, and EXG Safaris reserves the right to pursue legal and collection remedies under California Civil Code §3300 et seq.
Cancellation Policy and Fee Deduction Notice: pursuant to the consumer protection laws of the State of California, any transaction fees incurred from third-party services, bank transactions, and applicable governmental fees will be deducted from the refund amount owed to the customer. This includes, but is not limited to, fees charged by payment processors, financial institutions, and any charges mandated by governmental authorities. The exact amount of these fees may vary based on the specific services and entities involved in the transaction.
7. Issues During Your Trip
We want to make your trip unforgettable and meet all your wishes and demands. Should any inconvenience arise during your trip, please let your guide or the staff know immediately.
We will leave no stone unturned to solve the problem as quickly as possible — an honest word on the spot is more effective than a subsequent letter of complaint.
8. Travel Insurance Requirement
All travelers are required to carry comprehensive travel insurance covering trip cancellation, medical emergencies, evacuation, repatriation, baggage, and interruption.
Failure to obtain adequate coverage releases EXG Safaris from any related liability or financial responsibility.
9. Client Responsibilities
Travelers are solely responsible for possessing valid travel documents (including passports and visas), meeting all health and vaccination requirements, and complying with the laws and regulations of the destination country.
Failure to comply with these obligations does not entitle the traveler to any refund or compensation.
10. Responsibility & Liability Limitation
EXG Safaris acts solely as a booking agent for independent suppliers (lodges, airlines, ground transport).
EXG Safaris is not liable for injury, illness, loss, damage, delay, or expense caused by suppliers, acts of nature, war, strikes, civil unrest, or government actions.
Traveler assumes all inherent risks associated with travel in remote destinations.
In no event shall EXG Safaris' liability exceed the amount paid by the traveler for services rendered.
California Civil Code §1668 disclaimer: nothing herein releases EXG Safaris from gross negligence or willful misconduct, but EXG Safaris disclaims all other implied warranties to the maximum extent permitted by law.
11. Jurisdiction & Dispute Resolution
This agreement is governed by the laws of the State of California.
Any dispute shall be resolved exclusively by binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association (AAA).
Each party shall bear its own legal fees and costs unless otherwise ordered by the arbitrator.
Traveler waives the right to participate in any class action or jury trial.
12. Force Majeure
EXG Safaris shall not be deemed in breach for any failure to perform resulting from causes beyond its reasonable control, including but not limited to natural disasters, pandemics, border closures, or governmental restrictions.
13. Media & Marketing Release
By participating in an EXG Safaris safari, you grant EXG Safaris permission to use photographs, videos, or testimonials for marketing purposes unless you provide written notice of objection prior to departure.
14. Severability
If any provision herein is deemed invalid, the remainder of the agreement shall continue in full force and effect.
15. Acknowledgment
By making a booking or paying any deposit, the traveler affirms that they have read, understood, and agreed to this policy; are physically fit and medically cleared for travel; and accept full responsibility for their decisions, insurance, and participation.
